Pulling Teeth: The State of Mandatory Immigration Detention

Harvard civil rights-civil liberties law review, Vol.45(2), pp.601-634
07/01/2010

Abstract

Civil rights Detention Immigration policy Noncitizens Risk assessment Immigrants
Persons are deemed subject to mandatory detention based on a complicated categorical analysis that does not consider the individual facts of a case. This approach, which prioritizes abstract legal categories over case-specific facts, does a poor job of assessing whether a person is actually a flight or security risk. Requiring the detained immigrant to prove that the government is substantially unlikely to win its case in order to defeat mandatory detention exacerbates the problem of unfairness.
