The issue presented is whether the United States Supreme Court should grant certiorari to review the propriety of the Idaho Supreme Court's dismissal of the deprivation of federal civil rights claim by the estate of an inmate who committed suicide based on the common law rule of abatement, that the victim's right of action for tort dies with the victim.
